The instant writ application has been preferred by the petitioners is quoted hereinbelow;
“That by means of this writ application, the petitioners, who were validly appointed against the sanctioned post of teaching staffs in Yogda Satsanga Vidyalaya, Jaganathpur, Dhurwa, Ranchi, a Government Recognized Minority Aided High School, and whose appointments were also approved by the concerned competent authorities, humbly pray for issuance of an appropriate writ / writs, order/orders, direction/directions in the nature of mandamus directing the respondents particularly the respondent no. 3 (District Education Officer, Ranchi), to re-fix his pay on 01.01.1996 in revised pay scale introduced by the State Government, vide resolution no. 2315, dated 20.08.2007 (Annexure-5 to this writ application) after adding /quantifying amount of interim relief and teaching allowance, in the light of Govt.'s decision, as his pay in revised pay scale has been fixed on 01.01.1996 without adding /quantifying the amount of teaching allowance and interim relief by the respondent no.3 (District Education

Officer, Ranchi), who is the Low Ranking Officer than Secretary Government (respondent to the no.1) in utter violation of Government's decision and also to re-fix his pay on 01.01.2006 in revised pay scale accordingly and pay the consequential benefits payable with effect from 01.04.1997 and 01.01.2006 respectively. AND/OR Pass such other appropriate writ (s), order (s), direction (s) as Your Lordships may deem fit and proper for doing conscionable justice to the petitioners.”

Learned counsel for the petitioners submits that the issues involved in this writ application is covered by the
judgment passed by the Co-ordinate Bench of this Court in W.P.(S) No. 1386 of 2009 along with analogous cases; as such similar benefit may be given to these petitioners.

Learned counsel for the respondents fairly supports the aforesaid contention and submits that the issue has already been decided in W.P.(S) No. 1386 of 2009 along with analogous cases; as such the petitioners may be directed to approach the concerned respondent so that their cases can be considered in the light of the aforesaid judgment.
4. Having regard to the fair submission of learned counsel for both the parties, the instant writ application is, hereby,
disposed of by directing the concerned respondent to consider the case of the petitioners and take a decision in the matter in the light of order passed in W.P.(S) No. 1386 of 2009 along with analogous cases and similar benefit be given to these petitioners also what has been given to the petitioners of the above referred case. The entire exercise shall be completed within a period of 12 weeks from the date of receipt/production of copy of this order.
5. With the aforesaid observations and direction, the instant writ application stands disposed of. Pending I.A. if any also stands disposed of.
