Heard learned counsel for the applicant, learned A.G.A. for the State and perused the record. 2. Present 483 Cr.P.C. application has been filed with the following prayer: "Wherefore, it is most respectfully prayed that this Hon'ble Court may be pleased to hear and allow the recall application No. 593 of 2023 along with application no. 142 of 2024 and provide the opportunity to be heard and matter be decided on merit to serve the end of justice." 3. It has been submitted by the learned counsel for the applicant that the applicant is paying the maintenance of Rs. 9,500/- per month to his wife and two daughters, namely, Km. Laxmi and Km. Preeti in compliance of ex-parte order dated 09.11.2021, passed in Criminal Misc. Case No. 1010 of 2020(Smt. Pushpa Devi and Others Vs. Ram Nath). Is further submitted that his daughters are highly qualified and they are now married, but still he is paying maintenance to them in compliance of ex- parte order dated 09.11.2021 passed by the learned Trial Court. It is further submitted that Recall Application No. 593 of 2023 has been filed before the learned Trial Court for recalling the ex-parte order dated 09.11.2021, so that he may defend himself before the Trial Court, but the same has not been decided till date. A typed copy of the order sheet has Versus Counsel for Applicant(s) : Rajendra Pratap Singh, Ayushi Dixit, Jyoti Singh, Richa, Rudra Pratap Singh Counsel for Opposite Party(s) : G.A. Ram Nath .....Applicant(s) State Of U.P. Thru. Acs Deptt. Home Lko. .....Opposite Party(s) also been filed along with the present application, which shows that the recall application has been filed on 10.05.2023, which is still pending considering the facts and circumstances and the submissions made by the learned counsel for the applicant. 4. In view of such facts of the case, present application is disposed of with direction to Trial Court to expedite the matter and decide the recall application as early as possible in accordance with law, preferably within one month from the date of production of certified copy of this order.
