HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 10689 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Supplementary affidavit filed today is taken on record. 2. Heard Sri Narayan Datt Tiwari, learned counsel for the applicant as well as learned A.G.A. and perused the record. Despite service of notice, no one appeared on behalf of the complainant. 3. The applicant seeks enlargement on bail in FIR No.98 of 2025, under Sections 137(2), 115(2), 74, 64 of BNS and Section 3/4 of POCSO Act, Police Station Sadullanagar, District Balrampur. 3. In terms of the FIR, it was alleged that the daughter of the informant aged about 17 years was met with the applicant and on 18.08.2025, on the false pretext of getting a job at Lucknow misbehaved with her. The FIR was lodged 26.08.2025. Subsequently, in the statement under Section 180 of BNSS, the victim stated that on the false pretext of getting job, the victim had gone along with the applicant to Lucknow and wrong was also committed. The medical on record naturally does not corroborate the allegation. 4. Learned A.G.A. vehemently opposed the bail prayer. 5. Considering the age of the victim and substantial delay in lodging of the FIR without any plausible explanation and the fact that the applicant has no criminal antecedents and is languishing in jail since 31.08.2025, I Versus Counsel for Applicant(s) : Narayan Datt Tiwari Counsel for Opposite Party(s) : G.A. Nishal @ Kallu .....Applicant(s) State Of U.P. Thru. Its Chief Secy. Home Lko. And 3 Others .....Opposite Party(s)
