Heard learned counsel for petitioners and learned state counsel for opposite parties. 2. Petition has been filed seeking a direction to opposite parties for payment of pensionary benefits in view of judgment rendered by Hon'ble Supreme Court in the case of Prem Singh v. State of U.P. and others [(2019) 10 SCC 516] as well as by this court in Writ A No. 731 of 2024 Jai Ram Sharma versus State of U.P. and others. 3. It is admitted that petitioners 2, 3, and 4 namely Awadh Narayan Yadav, Sishupal Singh and Vishwanath Yadav respectively are still in service while petitioner No.1 Vijay Bahadur has superannuated. 4. In view of the fact that petitioners 2 to 4 are still in service, the petition is dismissed as withdrawn with regard to the aforesaid petitioners, granting them liberty to approach this court again as and when cause of action arises. 5. With regard to petitioner No.1, liberty is granted to him to file a fresh representation before opposite party No. 2 i.e. Engineer-in-chief (Drawing and Planning) Irrigation and Water Resources Department, Lucknow or any other competent authority who is directed to decide the representation in the light of the judgment rendered in the case of Jai Ram Sharma (supra) in case the same is applicable. The decision shall be taken within a period of eight weeks from the date a certified copy of this order is produced before the said authority. 6. The petition stands disposed of.
