Respondent/s BEFORE HON’BLE MR. JUSTICE A. GUNESHWAR SHARMA Order 25.04.2025 [1] Present Mr. M. Chittaranjan, learned counsel for the petitioner, Mr. Lenin Hijan, learned A.G. assisted by Mr. RK. Milan, learned counsel and Mr. A. Bheigya, learned Jr. G.A. for the respondents. [2] By the present petition, the petitioner approached this Court for setting aside the notice dated 10.09.2024 issued by the Executive Officer, Shree Shree Govindajee Temple Board removing the petitioner from Angom Ningthouship and directed him to hand over the charge of Cheirap Loishang to respondent No. 2. [3] The main ground in the writ petition is that no notice was given to the petitioner before removing him from Angom Ningthouship and from the charge of Cheirap Loishang of Shree Shree Govindajee Temple Board in violation of the statutory rules and principle of natural justice. [4] During the course of hearing, Mr. Lenin Hijam, learned A.G., fairly concedes that while issuing the impugned notice dated 10.09.2024, no notice was issued to the petitioner. Learned A.G. draws the attention of this Court to Rule 13 of Shree Shree Govindajee Temple Rules, 1973 where it has been stipulated that one month prior notice in writing be given for termination of any appointment in the board. [5] It is submitted that the impugned notice dated 10.09.2024 may be set aside with liberty to the board to initiate any fresh proceeding against the petitioner as per rule. [6] Mr. M. Chittaranjan, learned counsel for the petitioner, points out that vide order dated 08.10.2024, this Court kept in suspension the operation of the impugned notice dated 10.09.2024 till next date and interim order has been extended from time to time and till today, the petitioner is in-charge of Angom Ningthouship in terms of the interim order. [7] This Court considers the materials on record and the submissions made at the bar. Accordingly, the impugned notice dated 10.09.2024 issued by the Executive Officer, Shree Shree Govindajee Temple Board removing the petitioner from Angom Ningthouship is set aside with liberty to the board to take appropriate steps against the petitioner in terms of rule. In the circumstances and till then, the petitioner shall not take any major decision except for normal functioning and other routine works. [8] It is clarified that this Court does not express any opinion on the merit of the case and the impugned order is set aside solely on the basis of violation of principle of natural justice.
