Heard learned counsel for petitioner and learned State counsel for opposite parties. 2. Present petition has been filed seeking a direction to concerned authority for providing benefits of Assured Career Progression Scheme and the order dated 22.04.2024 passed in Writ A No.1367 of 2022; Deependra Prakash Tiwari versus State of U.P. & Ors.. Correct fixation of salary and computation of pension with interest thereafter has also been sought. 3. Since consideration of petitioner's grievance would entail factual aspects, without entering into merits of the case, liberty is granted to petitioner to file a fresh representation before opposite party No.3 i.e. District Magistrate, Sultanpur. In case such a representation is filed, the same shall be considered and decided in the light of judgment rendered in the case of Deependra Prakash Tiwari (supra) in case the same is application within a period of six weeks from the date a certified copy of this order is produced before the said authority. 4.
