1. Heard.
2. Learned counsel for the appellants would submit that instant miscellaneous appeal has been preferred by the appellants challenging the Order dated 20.03.2024 passed by the District Judge Bemetara (C.G.) in Civil Suit No.5- A/2023, whereby, the application under Order 39 Rule 1 & 2 of CPC filed by the appellants/plaintiffs was dismissed. She further submits that aforesaid civil suit has been decided by the trial Court, therefore, the matter has become infructuous.
