HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW S.C.C. REVISION DEFECTIVE No. - 15 of 2025 Court No. - 6 HON'BLE JASPREET SINGH, J. The learned counsel for the revisionist has fairly pointed out that against the ex-parte order which has been impugned in the instant revision, the revisionist had already filed an application under Order 9 Rule 13 C.P.C. accompanied by an application under Section 5 of the Limitation Act, 1963, however, the matter is already seized by the Trial Court and his application under Section 5 of the Limitation Act has been allowed, hence, he does not wish to press the instant revision. It is accordingly dismissed as withdrawn. It shall be open for the petitioner to take recourse and pursue his remedy as available to him in law.
