HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - A No. - 14358 of 2025 Court No. - 7 HON'BLE MANISH MATHUR, J.
1. Heard learned counsel for petitioner and learned State Counsel for opposite parties.
2. Petition has been filed seeking a direction to authority concerned to consider petitioner's transfer from Sonbhadra to Lucknow or nearby places, such as Kanpur Nagar and Barabanki in view of paragraph - 4 of the Government Order dated 06.05.2025.
3. It is submitted that petitioner is currently employed in an aspirational district and the Government Order specifically provides choice posting after completion of two years in such an aspirational district.
4. Since petitioner has already spent more than two years in the aforesaid district, such transfer is being sought.
5. Learned State Counsel has refuted submissions advanced by learned counsel for petitioner with the submission that policy was issued in May, 2025 and therefore relief being sought is highly belated almost six months.
6. Upon submission of learned counsel for parties and perusal of material on record, aspect of seeking transfer in terms of paragraph - 4 of the Government Order is evident which provides for choice posting to persons who have spent more than two years in such an aspirational district. However, since the policy was issued in May, Versus Counsel for Petitioner(s) : Anurag Narain Srivastava, Chitrangada Narayan, Shailendra Kumar Misra Counsel for Respondent(s) : C.S.C. Sanjay Asthana .....Petitioner(s) State Of U.P. Secy., Medical Health And Family Welfare Deptt. Lko. And Another .....Respondent(s)
2025, petition having been filed in December, 2025 appears to be belated.
7. In such circumstances, liberty is granted to petitioner to seek the said posting in next annual transfer. In case any such representation is made, same shall be considered and decided expeditiously.
8. With the aforesaid direction(s), petition stands disposed of. December 16, 2025 lakshman WRIA No. 14358 of 2025 2 (Manish Mathur,J.) Digitally signed by :- LAKSHMANA KUMAR TAMMANA High Court of Judicature at Allahabad, Lucknow Bench
