Heard learned counsel for the applicant, learned A.G.A. for the State. 2. The instant application has been filed seeking release of the applicant on bail in Case Crime No.103 of 2025 under Sections 352, 326(G), 131, 351(2) of B.N.S. registered at Police Station- Tarabganj, District- Gonda. 3. The aforesaid case has been registered on the basis of an F.I.R. lodged on 17.04.2025 against three persons, including the applicant, stating that all the accused persons had set the hatched roof of the informant's hut ablaze at about 09:00 PM on 16.04.2025. When the complainant complained about it, all the accused persons chased her and her son by threatening to beat them up with sticks. Learned counsel for the applicant submits that the co-accused Pramukh Yadav has been enlarged on bail by this Court vide order dated 11.09.2025 passed in criminal misc. bail application No. 8583 of 2025. Learned counsel for the applicant seeks parity with the order of the co- accused. 4. In the affidavit filed in support of the bail application, it has been stated that the applicant has been falsely implicated in the present case due to village politics. The applicant has explained his criminal antecedent of one case in the supplementary affidvait. Versus Counsel for Applicant(s) : Kunwar Bahadur Singh Counsel for Opposite Party(s) : G.A. Learned A.G.A. has vehemently opposed the bail application and on the basis of written instructions, he has submitted that allegations have been established during investigation and a charge-sheet has been submitted on 23.05.2025. 6. Having considered the aforesaid facts and circumstances of the case and keeping in view the fact that co-accused Pramukh yadav has been granted bail, the FIR or the statements did not disclose any reason/motive for commission of the offence and he is languishing in jail since 20.04.2025 whereas the investigation stands concluded, I am of the view that the aforesaid facts are sufficient for making out a case for enlargement of the applicant on bail in the aforesaid case. 7. Accordingly, this bail application stands allowed. 8. Let the applicant- Hukumdutt Yadav @ Pawan Yadav be released on bail in the aforementioned case on furnishing a personal bond and two sureties each in the like amount to the satisfaction of Magistrate/Court concerned, subject to following conditions:- (i) the applicant shall not tamper with the prosecution evidence; (ii) the applicant shall not pressurize the prosecution witnesses; (iii) the applicant shall appear on each and every date fixed by the trial Court.
