HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 1904 of 2025 Court No. - 12 HON'BLE PANKAJ BHATIA, J.
1. Heard learned counsel for the applicants, learned AGA and perused the record. 2. The applicant seeks enlargement on bail in FIR No. 196 of 2024, under sections 70(1), 333, 191(2), 115(2), 351(3) BNS, P.S. Alambagh, District Lucknow. 3. Learned counsel for the applicants argues that in terms of FIR lodged on 29.10.2024 it was alleged that the informant aged about 28 years was at home on 29.9.2024 alongwith child aged four years when the applicants came and committed wrong on her. Allegations were levelled against co accused also. In the light of the said allegations learned counsel for the applicants argues that a civil litigation is going in between the parties because of which false FIR was lodged. There is delay of one month in lodging the FIR without giving any explanation. The FIR in question also implicates two ladies for no reasons whatsoever. Considering the arguments prima facie in terms of FIR the incident is said to be occurred one month ago. No material exists to indicate the name of two other co accused who are lady members of family of the applicant. Civil litigation is going and the allegations are highly improbable as the daughter of the informant was also with her. 4. Learned AGA has opposed the bail application. Versus Counsel for Applicant(s) : Nitish Kumar Yadav, Ram Naresh Yadav, Vineet Kumar Chaurasia Counsel for Opposite Party(s) : G.A, Abhilasha Nishad, Virat Singh Vikrant And Another .....Applicant(s) State Of U.P. Thru. Secy. Home And Another .....Opposite Party(s)
5. Considering the facts and circumstances, however, without commenting upon the merits of the case, the applicants who are in jail since 28.11.2024 and have no criminal history are entitled to be enlarged on bail. In view thereof, the application is allowed. 6.
Let the applicants Vikrant and Vikky @ Vishwanath be released on bail in aforesaid FIR number on their furnishing personal bonds with two sureties of Rs.20,000/- each to the satisfaction of court concerned with the following conditions: (a) The applicant shall execute a bond to undertake to attend the hearings; (b) The applicant shall not commit any offence similar to the offence of which they are accused or suspected of the commission; and (c) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer or tamper with the evidence.
