Petitioner has been made accused in connection with Dhab P.S. Case No.02 of 2025 for the offences punishable under sections 191(2), 191(3), 190, 126(2), 115(2), 118(1), 109(1), 121(1), 121(2), 132, 303(2), 317(2), 324(5), 324(6) & 62 of the B.N.S., 2023, under Section 21(1) of the M.M.D.R. Act, under Rule 54 of the J.M.M.C. Rules and under Sections 33, 33A & 42(1) of the Indian Forest Act, pending in the Court of learned S.D.J.M., Koderma. 30.03.2025 at about 5:15 A.M., Dhab police on the basis of confidential information that illegal mining was taking place near Goriadih village, raided the place of occurrence. It is alleged that on seeing the police party 38 named accused persons at about 40-50 unknown persons assaulted the police party causing injury to police personnels. It was submitted that petitioner is neither named in the F.I.R. nor he was put on T. I. Parade. It was further submitted that the name of the petitioner has transpired in confession of co-accused. It was finally submitted that similarly situated co-accused persons have been granted bail different Co-ordinate Benches of this Court. Mr. Rajesh Kumar, learned A.P.P. has opposed the prayer for bail. In view of the submissions made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned S.D.J.M., Koderma, in connection with Dhab P.S.
