The petitioner is a software engineer working with a multi- national company. During the course of his work, he is called upon to travel abroad. Hence he applied for issuance of a passport to the third respondent. The third respondent sought for a clarification from the fourth respondent. The clarification was as regards a criminal case that has been filed against him in Crime No.366 of 2024 by the fifth respondent. The petitioner states that the final report was filed and the same has been taken on file before the Judicial Magistrate-I, Thiruvannamalai as C.C.No.953 of 2025. He pleads that the case is still at the stage of trial. On account of the pressing necessities of work, he requires the passport and hence has filed this writ petition. 2. I heard Mr.K.B.Arul for the respondents 1 to 4. I have gone through the https://www.mhc.tn.gov.in/judis WP No.50467 of 2025 papers and carefully considered the submissions of both sides. 3. For the mere fact that a criminal complaint is pending does not mean that the petitioner should be barred from receiving a passport. The petitioner shall file an appropriate application before the learned Judicial Magistrate-I, Thiruvannamalai in C.C.No.953 of 2025 seeking permission of the Court to leave the country. In the event of the application being allowed, the respondents 1 to 4 on the said basis shall issue the passport. 4. The writ petition stands disposed of.
