2 Khamtarai, District - Raipur (C.G.), for the offence punishable under Sections 408, 420, 467, 468, 469, 470, 471 and 34 of IPC. First anticipatory bail i.e. MCRCA No. 1260 of 2024 filed by the applicant was dismissed on merits by this Court vide
order dated 25.10.2024.

Prosecution case in brief is that the complainant Manoj Parsampuria, Managing Director of Indo Chains Private Limited situated at Plot No.12 and Plot No.14 industrial area Raipur (C.G) has filed a complaint at Police Station Khamtarai on 24.09.2024 stating that his company manufactures and designs various types of chains and its gears, that on 13.06.2022 one Devbrat Benarjee was appointed as marketing and sales manager and whereby he was given the work of marketing and sales of the products manufactured by the company and thereafter all the confidential and important documents, data of the company was made available to him. On 18.09.2024 through one international market agent complainant came to know one company Contromac Engineering Solutions which is run by Simmi Mann wife of Devbrat Benarjee in there official website where the information and photos of the equipments and the design of the equipments before manufacturing is the same which is manufactured and drawn by the official designers of the complainant's company which is a confidential document of the
3 company. After collecting the information some of the earlier employees of the complainant's company are found to be employed in Contromac Engineering Solutions which includes one Aushotosh Parate (Co-ordinator) who was the Secretary of the one of the Director Manish Parasampuria and Deepak Saha who was the executive of Digital marketing. That, Aushotosh Parate had sent various confidential information and data of complainant's organisation through emails and whats app when he working with the complainant's organisation and one Deepak Sah is doing the digital marketing of the alleged accused's company in the same manner as he was doing for the complainant's company. That, the complainant alleged the accused persons conspired for causing wrongful gain to themselves and wrongful loss to the company by committing fraud by forging the valuable documents and securities of the company and committing criminal breach of trust caused irreparable loss worth several crores to the company therefore the offences to be registered against the accused persons. On the basis of the written complaint aforesaid offence has been registered against the applicant.

Learned counsel for the applicant would submit that the applicant is innocent person and he has not committed any offence as alleged by the prosecution and he is falsely
4 implicated in the present case. He also submits that during the course of investigation no evidence is collected by the Investigation Officer that the present applicant has sent any confidential/secret information/documents of the Indo-Chain Company to co-accused Devbrat Banerjee to cause financial loss to the complainant’s company and only being an employee of the Contromac Engineering Solution the present applicant had been falsely implicated in the present case. He further submits that the applicant was a prior employee of the company of the complainant and has resigned from his post and thereafter,the applicant has joined the company of the co- accused Simmy Mann. He further submits that other co- accused namely Simmy Mann and Devbrat Banerjee who have already been granted bail by this Court in MCRCA No. 1247/2024 vide order dated 25.10.2024 and MCRC No. 1352/2025 vide order dated 18.02.2025 and prays for grant of anticipatory bail to the present applicant.
5. On the other hand, learned State counsel appearing for the Non-applicant would oppose the prayer for grant of anticipatory bail of the present applicant.
6. I have heard learned counsel for the parties and perused the case diary.
7. Considering the facts & circumstances of the case, that the allegation levelled against the applicant is grievous in nature
5 that the applicant in connivance with other co-accused has committed the offence as alleged and was also earlier employed in the company of the complainant and co-accused who was granted anticipatory bail by this Court in MCRCA No. 1247 of 2024 vide order dated 25.10.2024 on the ground of lady, as such, I am not inclined to grant anticipatory bail to the present applicant.

Accordingly, the second anticipatory bail application of the applicant - Deepak Sah, involved in Crime No. 767/2024, registered at Police Station Khamtarai, District Raipur (C.G.) for alleged commission of offence punishable under Sections 408, 420, 467, 468, 469, 470, 471 and 34 of IPC is rejected.
