Page No.# 2/3 Sanhita, 2023, the accused petitioner namely, Onkar Singh, has prayed for bail in connection with Moran P.S. Case No. 52/2025, registered under Section 108 of BNS, 2023. 3. The ejahar dated 24.05.2025 was lodged by one Karanjit Singh, brother of the deceased. The gist of the allegation is that the sister had love affair with the present accused and it was objected to by him and his mother; that subsequently they noticed some behavioral change in his sister and eventually on 22.05.2025 in the morning, she committed suicide by hanging. 4. The learned counsel for the petitioner submits that accused is innocent and there is no element of abatement of suicide in the allegation. It is also submitted that the petitioner has been in custody for more than 50 days. 5. Mr. D.P. Goswami, learned Additional Public Prosecutor for the State submits that the case diary has been received and as per PM report, it was a case of suicidal death and the investigation has progressed but the same has not been completed. It is also submitted that there was material against the present petitioner though the aspect of abetement would perhaps be a matter of trial. 6. On the face of it, the unfortunate incident taken appears to have place in the backdrop of love affairs and difficulty in the relationship on the account of family opposition. Nevertheless, the alleged offences are the matter of full investigation as rightly submitted by the prosecution. 7. In view of the profress of investigation, I am of the considered opinion that the accused can be granted bail at this stage subject to suitable condition(s). Page No.# 3/3
8. Accordingly, the accused-petitioner, named above, shall be released on bail in connection with Mukalmua P.S. Case No. 90/2025 (Corresponding to GR No. 297/2025), registered under Section 109(1)/118(2)/117(2)/76 of BNS, 2023, on furnishing bail bond of Rs.25,000/- with one suitable surety of the like amount to the satisfaction of learned concerned court. 9.
The direction for bail is further subject to the conditions: (a) That the accused shall co-operate with remaining investigation; (b) That the accused shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer; and (c) That the accused shall not hamper or tamper any evidence. 10. Violation or breach of any condition(s) shall entail cancellation of bail. 11. With the above observations, this bail petition stands allowed and
disposed of accordingly.
