IN THE HIGH COURT OF ORISSA AT CUTTACK TRP (C) No.48 of 2025 Aparna Agarwalla …. Petitioner Mr. Koustav Mohanty, Advocate -versus- Sunil Agrawala …. Opposite Party CORAM: HON’BLE MR. JUSTICE MURAHARI SRI RAMAN Order No. 02. ORDER 02.04.2025 This matter is taken up through Hybrid Mode. 2. This petition has been filed by the learned counsel appearing for the Petitioner-wife under Section 24 of the Civil Procedure Code, 1908 for transfer of MAT Case No.141 of 2024 filed under Section 9 of the Hindu Marriage Act, 1955 by the Opposite Party- husband for restitution of conjugal Right, which is stated to be pending in the Court of the learned Judge, Family Court, Bargarh to the Court of the learned Judge, Family Court, Phulbani. 3. Learned counsel for the Petitioner submitted that the petitioner is residing at Phulbani and she is required to cover around 250 KṂs from her residence to attend the Court proceeding, which is very inconvenient for her. Therefore, the aforesaid MAT Case No.141 of 2024, which is stated to be pending in the Court of the learned Judge, Family Court, Bargarh requires to be transferred to the Court of the learned Judge, Family Court, Phulbani for convenience. 4. Considering the contention, this Court declines to entertain this application for transfer, which is, therefore, dismissed. It will be open to the petitioner to seek permission of the Court concerned to appear through virtual mode. In the event such a prayer is made, the Court concerned shall not insist upon the personal attendance of the petitioner unless absolutely necessary. 5. With the aforesaid observation, this TRP(C) stands disposed of. (M.S. Raman) Judge Suchitra
