Sri Ram Kumar Singh, learned counsel appearing for the opposite parties no. 2 & 3 submitted that on 29-01-2019, one of legal heir of the deceased employee has been appointed on Class IV post and he has placed the copy of the order dated 29-01-2019, whereas, learned counsel appearing for the petitioner has opposed the contentions aforesaid and submitted that Mr. Sunil Kumar Rathore has been appointed on daily wage basis in the year 2008. This court prima-facie, finds the contention of the learned counsel for the petitioner incorrect as the order dated 29-01-2019 shows that the same has been considered and passed under Uttar Pradesh Recruitment of Dependants of Government Servants Dying-in- Harness Rules, 1974 and therefore, the present writ petition is hereby dismissed with liberty to the petitioner to challenge the order dated 29-01-2019, if he so desires.
