Order 16/07/2025
1. Matter comes up on an application (2/2025) for vacation of stay order dated 27.05.2025.
2. While passing the stay order dated 27.05.2025, liberty was granted to the respondents to file application for vacation of stay
order as also to raise the issue of territorial jurisdiction of Rajasthan High Court, to entertain the present writ petition.
3. Counsel appearing on behalf of respondent No.1, in reply to writ petition so also in the application for vacation of stay order, has raised a preliminary objection that no cause of action or part
[2025:RJ-JP:26522] (2 of 2) [CW-7351/2025] of cause of action has arisen to petitioner within jurisdiction of Rajasthan High Court, to file the instant writ petition.
4. It has been pointed out that both the vacant posts of Probationary Officer (Legal) E-II Grade, notified by the respondent No.1- Bharat Electronics Limited, after recruitment, appointment is to be made at Bengaluru (Bangalore). The institution of respondent No.1 is indisputably located at Bengaluru and written examination for recruitment on these vacant posts was conducted at New Delhi, hence, at Jaipur no cause of action has arisen for the present recruitment.
5. Petitioner, present in person, is fair enough to accept the aforesaid contentions and submits that since petitioner submitted Online Application Form for the examination of the posts in question from Jaipur, hence he was under impression that in all his bonafides, partial cause of action has arisen in Jaipur as well, therefore, he filed instant writ petition before this Court, however now petitioner is agreeable to withdraw the writ petition from this Court with liberty to file afresh before the High Court having territorial jurisdiction.
6. In view of the statement of petitioner, the writ petition is dismissed as withdrawn for want of territorial jurisdiction of this Court.
7. The stay order dated 27.05.2025, passed in favour of petitioner, stands vacated.
8. Accordingly, the stay application so also the application for vacation of stay order stand disposed of.
