Project Director And Ex Officio Deputy Secretary (Sap), Rural Development Department, Secretariat, Jaipur. 3. Development Officer, Panchayat Samiti- Sapotara, District- Karauli. ----Respondents For Petitioner(s) : Mr. Manish Kumar Sharma For Respondent(s) : Mr. Kapil Prakash Mathur, AAG with Mr. Ashutosh Udawat Mr. Saurabh Sharma HON'BLE MR. JUSTICE AVNEESH JHINGAN Order 30/07/2025 1. These petitions are decided by common order as the facts and issues involved are similar. For the sake of convenience, the facts are being taken from SBCWP No.6926/2025. 2. This petition is filed by the Administrator challenging order dated 22.04.2025 of the Development Officer. 3. By impugned order payments to be made from bank accounts of the Gram Panchayat were restrained consequent to pending enquiries into the complaints received. 4. A specific query was raised from the counsel for the petitioner that the accounts relate to Gram Panchayat and Gram Panchayat is not before this Court. Further that there is no resolution or authorization in favour of the petitioner to file writ petition on behalf of Gram Panchayat. [2025:RJ-JP:28893] (3 of 3) [CW-6926/2025] 5. Learned counsel for the petitioner contends that since the bank account is to be operated by the Administrator therefore, the petition can be filed by the Administrator. 6. The argument raised deserves to be rejected for the following reasons:- i. As per the order, there are complaints received of financial irregularities which are being enquired into and as interim arrangement to protect the interestsof the gram panchayat, the payments have been stopped. ii. The funds belong to the gram panchayat and Administrator is authorised to operate the account having been appointed as a stop-gap arrangement till the elections are conducted and cannot raise a grievance independent of the gram panchayat for seeking quashing of the order. iii. There is no resolution or authorization by Gram Panchayat in favour of the petitioners to file writ. 7. The writ petitions are dismissed as not maintainable due to lack of locus standi and in absence of any authorization or resolution by the Gram panchayat in favour of the petitioner to file this petition.
