This petition under Section 482 BNSS is filed by the petitioner, namely, Fatinur Ali, apprehending arrest in connection with Barama P.S. Case No. 61/2025 registered u/s 310(2) of BNS, 2023. Page No.# 2/2 3. The allegation in the FIR dated 16.07.2025 is decoity of a truck bearing registration No. RJ09QE6232 carrying pan masala of Rs.80 lakhs. It is submitted by the learned counsel for the petitioner that his mouth was gagged by cloth and left near Bhawanipur Out Post, whereupon he informed the said Out Post and his mobile phone was left in the truck, from which the police gathered more information. 4. Learned Additional Public prosecutor submits on the basis of the case diary that though the present petitioner was stated to be a victim and driver of the truck which was looted by dacoits and he was left at another place after gagging his mouth but investigation reveals that actually he was one of the assailants and was who was driving another vehicle which was involved in the dacoity of the truck carrying pan masala. 5. The present petitioner was granted interim bail on 18.08.2025 on the basis of materials existing then. As the investigation is not yet completed and different aspects have emerged, therefore, it would be prudent to cancel the interim bail. 6. Accordingly, the interim bail application stands rejected and the interim order stands vacated. 7. Return the case diary. 8. This disposes of the bail application. JUDGE Comparing Assistant
