Heard learned counsel appearing on behalf of the parties. 2. The present writ petition has been filed with the following prayer:- "I. Issue a writ, order or direction in the nature of MANDAMUS, commanding and directing the Opposite party no. 2 District Magistrate District- Raebareli, to decide the application dated 06-10-2025 moved by the petitioner through registered post, as the contained in Annexure No. 6 to this writ petition. II. Issue a writ, order or direction in the nature of MANDAMUS, commanding and directing the opposite parties to the petitioner to pay compensation on the basis of market rate for land measuring 114.94 sq. meters on 08.07.2022 and 59.52 sq. meters on 24.12.2022 out of total land measuring 174.46 hectares situated in Gata No. 694, Village- Sulakhiapur, Pargana and Tehsil-Sadar, District-Raebareli." 3. Upon perusal of the application made by the petitioner, we are of the view that the application may be treated as an application under Section 3G(5) of the National Highways Act, 1956. The District Magistrate, Raebareli is directed to grant an opportunity of hearing to the petitioner and thereafter pass a reasoned order in accordance with law.
