Heard learned counsel for petitioner, Mr. Anand Dwivedi, learned Counsel for respondent no. 1 and Ms. Nidhi Singh, learned counsel for respondent nos. 2 & 3. 2. The present petition has been filed with the following main relief:- "i. A writ, order or direction in the nature of Mandamus Directing to the opposite party no-3 Additional General Manager, (Unit Head) ITI limited, Doorbhash Nagar, Raebareli, U.P. to pay post retiral dues total amount of Gratuity. Provident Fund and Privileged leave encashment payable to the Petitioner, Which are admittedly due available for the values of Privilege leave encashment,PF, Gratuity amount along with interest." 3. Since consideration of petitioner's grievance would entail factual aspects, without entering into merits of the case, liberty is granted to petitioner to move a fresh representation before respondent No. 3 i.e. Additional General Manager (Unit Head) ITI Limited, Raebareli, U.P. In case such a representation is filed, the same shall be decided within period of eight weeks from the date Versus Counsel for Petitioner(s) : Anil Kumar Yadav Counsel for Respondent(s) : A.S.G.I., Nidhi Singh Radhe Shyam Yadav .....Petitioner(s) U.O.I. In case petitioner is found entitled for the aforesaid benefits, actual payment thereof shall be ensured within a period of eight weeks thereafter.
