Mr. B.D. Pande, Advocate for the petitioner. 2. According to petitioner, he has moved an application under proviso to Rule 11(5) of Payment of Gratuity (Central) Rules, 1972, seeking recall of an ex-parte order passed by Controlling Authority. Alongwith the said application, petitioner has also moved an application, seeking stay of the recovery proceedings. The said application is said to be filed on 18.11.2024. Since the application filed by petitioner has not been considered so far, therefore, petitioner has sought a direction to the Controlling Authority to dispose of the application filed by petitioner, within a stipulated time. 3. Learned counsel for the petitioner submits that, because of the ex-parte order passed by the Controlling Authority, coercive measures are likely to be taken against the petitioner and, if assets of the petitioner are attached in execution of the order passed by Controlling Authority, he shall suffer irreparable loss. 4. Having regard to the fact that petitioner’s application, seeking recall of the order is pending consideration before the Controlling Authority, therefore, the writ petition is disposed of with a direction to the Controlling Authority to take decision on the said application, one way or the other, within a period of four weeks’ from the date of production of certified copy of this order.
