Heard learned counsel for the petitioners and Mr. Prashant Kumar Singh learned counsel for the respondent nos.3 & 4 and Dr. Uday Veer Singh learned counsel for the respondent nos. 1 & 2. Contention of the learned counsel for the petitioner is that the petitioner has been retired on 28th February 2025, but the pension as well as the gratuity has not been paid as yet though the services of the petitioner is covered with the provisions of U.P. Retirement Benefit Rules, 1961 and the General Provident Fund (Uttar Pradesh) Rules, 1987. After argument at length, learned counsel for the petitioner submits that the interest of Justice would be subserved if this Hon'ble Court is pleased to give liberty to the petitioner to move fresh representation before the respondent no.3 while claiming his retiral dues including pension and gratuity and the respondent no.3 may be directed to consider and decide the same within stipulated period of time as may be fixed by this Court. Learned counsels for the respondents have no objection to the submissions aforesaid. Be that as it may, without entering into the merits of the case, the petitioner is given liberty to move fresh representation before the respondent no.3/Vice Chancellor, Acharya Narendra Dev University of Agriculture and Technology, Kumarganj, Ayodhya within a period of fifteen days and if Versus Counsel for Petitioner(s) : Vinod Kumar Yadav, Amit Yadav, Sayyed Farooq Ahmad Counsel for Respondent(s) : C.S.C., Prashant Kumar Singh Ram Newal Yadav And Another .....Petitioner(s) State Of U.P. And 4 Others .....Respondent(s) such representation is moved, the respondent no.3 shall consider and decide the same in accordance with law, with speaking and reasoned order within further period of six weeks.
