Side) ********** 1/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.31345 of 2025 ORDER The petitioner, who was arrested and remanded to judicial custody on 31.10.2025, for the alleged offence punishable under Sections 4(1)(A), 4(1- A)(ii), 4(1)(C) of TNP (Amendment) Act, 2024, in Crime No.355 of 2025, on the file of the respondent police, seeks bail. 2. The case of the prosecution is that on 31.10.2025 the respondent police received secret information about the illicit distillation of liquor. On information, the respondent police went to the scene of occurrence and found that the petitioner was found in possession of 50 litres of Fermented Wash and 2 litres of Spirit with a Noxious Odour. Hence this case. 3. Learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He would further submit that the petitioner was arrested and in judicial custody from 31.10.2025 and ready to abide by any conditions that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner. 4. Learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution's case and submitted that this petitioner is ranked as A1 and the petitioner was found in possession illegally of 50 litres of Fermented Wash and 2 litres of Spirit with a Noxious Odour, hence the 2/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.31345 of 2025 petitioner arrested individual he has been detained under Act 14 of 1982. Hence, he strongly opposed for grant of bail to the petitioner. 5. Heard both sides and perused the materials available on record including the First Information Report. 6. Considering the submissions of the learned counsel on either side, the petitioner arrested individual he has been detained under Act 14 of 1982. Considering the serious allegations against the petitioner, this Court is not inclined to grant bail to the petitioner. 7.
