This petition is filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, by the petitioner, i.e., Miss Dikhshita Phukan, praying for granting her pre-arrest bail, apprehending arrest in connection with Bokakhat P.S. Case No.94/2025, registered under Section 61(2)/103(1) of the Bharatiya Nyaya Sanhita, 2023. 3. The gist of the case is that an F.I.R. was lodged by one Sabin Dowarah on 08.08.2025. It is alleged in the F.I.R. that on 08.08.2025 at the KNP quarter veranda under the office of the Director of Kaziranga National Park, one Smti. Dakhami Duwara was found dead by hanging with a curtain around her neck. It is further alleged that the incident did not look like suicide; therefore, suspecting some foul play, the F.I.R. was lodged. 4. Mr. S. Khound, learned counsel, appearing for the petitioner, submits that though the petitioner was named in the F.I.R., there was no specific allegation against her. He further submits that on 08.08.2025 the petitioner was called by the police for recording her statement, and accordingly, she gave her statement; however, since she was apprehending that she may be harassed, she approached this court by filing this anticipatory bail application. 5. Mr. Khound, learned counsel, also submits that this court on 18.08.2025 allowed the petitioner to be released on interim bail. Thereafter, the petitioner has again gone to the police station on 25.08.2025, wherein she was allowed to go on interim bail on furnishing of a bail bond as per the order dated 18.08.2025 of this Page No.# 3/3 court. 6. This court has heard Mr. R.J. Baruah, learned Additional Public Prosecutor, and after considering the entire facts of the matter and the submission made by the learned Additional Public Prosecutor as well as the learned counsel appearing for the petitioner, this court is of the view that this is a fit case wherein the petitioner’s prayer may be allowed by granting pre-arrest bail. 7. Consequently, the interim bail order passed by this court vide order dated 18.08.2025 is made absolute with the conditions as directed by the order dated 18.08.2025. 8.
