HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. WRIT PETITION No. - 8929 of 2025 Court No. - 11 HON'BLE ABDUL MOIN, J. HON'BLE MRS. BABITA RANI, J. 1. Application for correction in the memo of the petition filed today is taken on record. 2. On due consideration, the application is allowed. 3. Let necessary corrections be carried out during the course of the day. 4. Heard. 5. Instant writ petition has been filed praying for a writ of mandamus commanding the respondent No.1 to take appropriate action with regard to fix accountability of officer with respect to non compliance of the Uttar Pradesh Rani Lakshmi Bai Mahila Samman Kosh Rules, 2015 (hereinafter referred to as 'Rules, 2015') and further to pay compensation to the petitioner under Rules, 2015. 6. Contention of the learned counsel for the petitioner is that an FIR had been lodged by the mother of the petitioner on 14.05.2023 vide F.I.R. No.0221 of 2023 under Sections 363 and 366 IPC against one Shri Ankit, who is said to have enticed away the petitioner. 7. A specific averment has been made in para 10 of the petition that the investigating officer reached the conclusion that offence is made out in the aforesaid F.I.R. under Sections 363, 366, 376(3) IPC, 3/4(2) of the Protection of Children from Sexual Offences Act, 2015, Police Station Versus Counsel for Petitioner(s) : Mohammad Irfan Siddiqui Counsel for Respondent(s) : G.A. Victim X, In Fir No. -128 / 2023, Thru. Her Mother .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Woman Welfare Deptt. Lko. And Others .....Respondent(s) Inayat Nagar, District Ayodhya. 8. The contention is that despite the petitioner having applied for compensation under the Rules, 2015 vide application dated 21.08.2025, a copy of which is Annexure-3 to the petition, compensation under the Rules, 2015 has still not been paid and hence the petition. 9. Responding Shri Anurag Verma, learned A.G.A. on the basis of instructions sent by Shri Rammurti Kanaujia, Sub-Inspector, Police Station Inayat Nagar, District Ayodhya states that subsequent to lodging of the F.I.R. the petitioner has married the perpetrator and on account of said marriage, a child has been born who is now aged about 6 months. It is contended that the petitioner is not entitled to the benefit of the Rules, 2015. 10. However, considering the fact that the application of the petitioner for grant of the compensation under the Rules, 2015 is still pending for consideration before respondent No.1 and without entering into merits of the case, the writ petition is disposed of with a direction to the Principal Secretary, Women Welfare, Department, Government of U.P. i.e. respondent No.1 to take a final decision on the application of the petitioner in accordance with law under relevant rules, which order would be passed within a period of four weeks from the date of receipt of a certified copy of this order. 11. It is made clear that the Court has not entered into the merits of the claim set forth by the petitioner. October 29, 2025 prateek CRLP No. 8929 of 2025 2 (Mrs. Babita Rani,J.) (Abdul Moin,J.)
