Heard learned counsel for petitioner and learned State Counsel for opposite parties. 2. Petition has been filed seeking a direction to authority concerned for payment of gratuity, full pension and commutation of pension in view of the fact that petitioner has superannuated from service on 31.01.2019. 3. Learned counsel for petitioner submits that although petitioner has not been provided any reason for withholding aforesaid pensionary benefits, but submits that he was convicted under Sections 323 and 325 I.P.C. vide judgment and order dated 18.12.2023 in Sessions Trial No. 121 of 2013 but has been released on probation for a period one year. 4. Learned State Counsel has not been provided any written instructions particularly as to whether pensarionay benefits of petitioner have been withheld on account of merely conviction or a separate order being passed by the competent authority. 5. In view thereof, liberty is granted to the petitioner to file a fresh representation before opposite party No.2, i.e., Chief Engineer, Minor Irrigation Department, U.P., Lucknow or any competent authority, who shall consider and decide the same in accordance with law, Versus Counsel for Petitioner(s) : Syed Amir Hasan, Afaq Zaki Khan Counsel for Respondent(s) : C.S.C.
