Sunni Central Waqf Board. 2. By means of the instant petition filed in public interest, the petitioner has sought a direction to the opposite parties no. 2 & 3 to remove encroachment made over graveyard land. 3. The land is recorded in the name of a Waqf and the Waqf or its Mutwalli has not come forward. 4. Accordingly, the instant petition is dismissed leaving it open to the Waqf to initiate proceedings for removal of the encroachment.
