This anticipatory bail application under Section 482 of the Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023, has been preferred by the petitioners apprehending their arrest in connection with Manatu P.S. Case No.61 of 2019, for offences under Sections 341, 323, 307 and 34 IPC, Section 27 of the Arms Act and Section 33 of the Indian Forest Act. The case is presently pending before the Court of learned Sub Divisional Judicial Magistrate, Palamau at Daltonganj.

Learned counsel representing the petitioners submits that the petitioners have regularly appeared before the Investigating Officer in compliance of Notice under Section 35(3) of the BNSS and the Investigating Officer has not arrested him.

If the petitioners’ submission is correct, then I am of the opinion that there is no apprehension of the petitioners being arrested. Thus, this application is misconceived.

Accordingly, this Anticipatory Bail Application stands
disposed of, as being misconceived.
