This writ petition has been filed with the following prayer: "(a) Issue an order or direction, to the respondent no.2 i.e. Nayab Tehsildar, Tehsil Dumariyaganj, District Siddharth Nagar, to expedite the Case No.349 of 2022 Computer Case No.T202217630400349 (Abdul Mazeed Vs. Rojan), under Section 34 of U.P. Revenue Code, 2006 expeditiously within a time bound period as fixed by this Hon'ble Court." It is contended that Case No.349 of 2022 (Computer Case No.T202217630400349) filed under Section 34 U.P. Revenue Code 2006 is pending consideration before respondent no.2- Nayab Tehsildar, Tehsil Dumariyaganj, District Siddharth Nagar. The sole prayer made in the writ petition is to expedite the aforesaid case. As no useful purpose would be served in keeping the matter pending or issuing notice to the private respondent, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit, with a direction upon respondent no.2- Nayab Tehsildar, Tehsil Dumariyaganj, District Siddharth Nagar to decide Case No.349 of 2022 (Computer Case No.T202217630400349) filed under Section 34 U.P. Revenue Code 2006, in accordance with law, after hearing all affected parties, preferably within a period of three months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
