Heard Mr. Ghulam Mohammad Kamil, learned counsel for the petitioner, Mr. Piyush Kumar, learned Additional Chief Standing Counsel for the State and perused the records. The present writ petition has been preferred assailing the order impugned dated 05.09.2024, whereby, the payment of pension has been declined from the date of retirement i.e. 31.03.2022. The contention put forth by learned counsel for the petitioner is that the petitioner have been retired on 31.03.2022, wherein, the Govt. Order dated 12.12.2023 has been issued subsequently. He submitted that this issue has already been dealt with in the judgment and order rendered in the case of Ram Ji Pandey Versus State of U.P. and 5 Others passed in Writ A No. 2202 of 2024 decided vide order dated 24.04.2024, wherein, the ratio of judgment and order dated 21.04.2024 passed in Special Appeal Defective No. 976 of 2023 has also been considered, therefore, submission is that the present petitioner is also entitled for the same relief. Mr. Piyush Kumar Singh, learned Additional Chief Standing Counsel for the State do not dispute the aforesaid contentions. Upon considering the submissions of learned counsel for the parties, it is apparent that the petitioner was retired prior to issuance of the Govt. Order dated 12.12.2023 and this Court finds that the ratio of the judgment and order passed in Ram Ji Pandey(supra) is applicable in the case of present petitioner also, thus, this Court finds that the petitioner is also entitled for the Versus Counsel for Petitioner(s) : Ghulam Mohammad Kamil Counsel for Respondent(s) : C.S.C. Shabbir Ahmad Siddiqui .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Deptt. Education (Secondary ) Lko. And 5 Others .....Respondent(s) same relief. Consequently, the impugned order dated 05.09.2024 is hereby quashed. The writ petition is disposed of, in-terms of ratio of the judgment and order rendered in the case of Ram Ji Pandey(supra).
