HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW MATTERS UNDER ARTICLE 227 No. - 6770 of 2025 Court No. - 5 HON'BLE ALOK MATHUR, J.
1. Heard learned counsel for the petitioner as well as learned Standing Counsel for the State respondents.
2. In view of the order proposed to be passed, requirement of issuance of notice to private respondents are hereby dispensed with.
3. Instant petition has been filed by the petitioner praying for expediting the appellate proceedings filed by the petitioner which is pending since 3.9.2024 bearing appeal No.T202402570113413 "Balraj Tiwari and others Vs. Sandeep Kumar Tripathi and another" pending before Sub Divisional Magistrate, Tehsil Kunda, District Pratapgarh.
4. Learned counsel for the petitioner submits that grievance of the petitioner would be sufficiently met in case respondent no. 3 considers and decides the aforesaid case in the time bound manner, to which learned Standing Counsel has no objection.
5. A perusal of the order sheet indicates that the petitioner as well as opposite parties are not appearing on the dates fixed in the case on account of call for boycott by local bar association. Accordingly, in these circumstances no orders can be passed for expediting the proceedings which in any case would be futile considering the fact that the opposite parties are not appearing before the court on the dates fixed.
6. In case the petitioner appears on the next five dates fixed in the matter and his appearance is recorded in the orders sheet, liberty is granted to him to move appropriate application for expediting the proceedings.
