Heard learned counsel for the petitioner and perused the record. 2. Pursuant to order passed by this Court, supplementary affidavit filed on behalf of petitioner, is taken on record. 3. In view of the order proposed to be passed herein, no useful purpose would be served by putting the opposite party to notice and keeping this petition pending before this Court. However, in case the opposite party feels aggrieved by the order his/her right to seek modification/variation of the order is being kept reserved. 3. The basic relief sought by the petitioner in the present petition is to direct the court concern i.e Up-Zila Adhikari Tehsil Sadar, District Fatehpur (Respondent No. 2) to decide the Appeal No. 3856 of 2021 (Computerized Case No. T202202250113856) i.e. Hariday Ram Vs. Raja @ Rajola and Anothers, Under Section 35(2) of Uttar Pradesh Revenue Code, 2006, within stipulated period. 4. The matter is pending before the Court below since 2021 and considerable time has already been lapsed but till date no final decision has been taken in the matter. 5. In the facts and circumstances of the case, the present petition is disposed of directing the court concerned to decide the aforesaid case/suit strictly in accordance with law most expeditiously and preferably within a period of six months from the date of production of certified copy before the Court below but without granting unnecessary adjournment unless there is no legal impediment.
