The instant application has been filed seeking following main relief(s) :- "That for the facts, reasons and circumstances stated in the accompanying affidavit, it is most respectfully prayed that this Hon'ble court may graciously be pleased to set aside/quash the impugned charge sheet dated 8.11.2024 under section 420/467/468/471 IPC (now section 318 (4)/338/336 (3)/340 (2) of BNS-2023 respectively), Police station Wajeerganj, District Lucknow West, Commissionerate Lucknow submitted in First Information report No.0256/2023 and the impugned summoning order dated 2.12.2024 issued by the Additional Chief Judicial Magistrate V, Room No. 29, Lucknow in Criminal Case No.116400/2024, State versus Balwan Singh Yadav as well as entire proceeding of Criminal Case No.116400/2024, State versus Balwan Singh Yadav pending in the court of Additional Chief Judicial Magistrate, V, Room No.29, Lucknow, in the interest of justice." On account of some formal defects crept in the application, learned counsel for the applicant prays for withdrawal of the application with liberty to the applicant to file afresh with proper pleadings and documents in support Versus Counsel for Applicant(s) : Ramesh Singh, Himanshu Deepak Counsel for Opposite Party(s) : G.A. Balwan Singh Yadav .....Applicant(s) State Of U.P. Thru. Prin. Secy. Deptt. Of Home Lko. And Another .....Opposite Party(s) thereof. The aforesaid has not been opposed. In view of the above, the instant application is dismissed as withdrawn with liberty as prayed for.
