JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 3 08-05-2025 Heard learned counsel for the petitioner and learned APP for the State. 2. The petitioner seeks bail in a case registered for the offence punishable under Section-309 of Bhartiya Nyay Sanhita and Section-27 of the Arms Act. 3. It is alleged that while the informant was engaged in showing jwellery in his shop, the accused persons wrapping their face with Gamchha came there and demanded jwellery and consequence thereof, firing was also made. The informant was assaulted by butt of the pistol also as a result of which, he sustained injury. 4. It has been submitted on behalf of the petitioner that the petitioner is not named in the FIR. Nothing has been Patna High Court CR. MISC. No.8137 of 2025(3) dt.08-05-2025 2/2 recovered from his possession and his name has figured in confessional statement of co-accused Raju Kumar @ Raju Mukhiya. It has also been submitted that no TIP has been conducted. The petitioner is under incarceration since 30-09- 2024. 5. Learned APP has opposed the prayer for bail. 6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi in connection with Pupri P.S.
