HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL MISC. BAIL APPLICATION No. - 7829 of 2024 Court No. - 17 HON'BLE SUBHASH VIDYARTHI, J.
1. Heard Sri Rama Niwas Pathak, the learned counsel for the applicant and Sri Mayank Sinha, the learned AGA for State.
2. This is the second application seeking release of the applicant on bail in Case Crime No.0007 of 2023, under Sections 379, 420, 411 IPC and 66D Information Technology Act, 2000, Police Station Ramjanam Bhumi, District Faizabad/Ayodhya.
3. The first application No. 6301/2023 was rejected by means of an order dated 01.12.2023. This second application has been moved on the ground that the applicant is languishing in jail since 21.01.2023 and the trial has not concluded till date.
4. On the basis of the written instructions the petitioner has not brought on record the latest status of trial and on the basis of written instructions Sri Mayank Sinha, learned AGA states that out of total six prosecution witnesses, two witnesses have been examined and the matter is fixed for prosecution evidence on 10.11.2025.
5. Keeping in view the detailed reasons recorded in the order dated 01.12.2023, I am not satisfied that mere delay in conclusion of trial has made out a case for release of the applicant on bail by allowing his second bail application. Versus Counsel for Applicant(s) : D.P. Dutt Tiwari, Bal Ram Jakhar, Rama Niwas Pathak Counsel for Opposite Party(s) : G.A. Rohit Maurya .....Applicant(s) State Of U.P. Thru. Prin. Secy. Home Lko. .....Opposite Party(s)
6. Accordingly, his second bail application is rejected.
7. However, as the applicant is languishing in jail since 21.01.2023 and expeditious conclusion of trail is his fundamental right, it is provided that the trial court shall proceed with the trial expeditiously and conclude the same at the earliest by fixing dates on short intervals and by denying any unnecessary adjournment to any of the parties.
