[2025:RJ-JP:27291] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Civil Writ Petition No. 7103/2025 Pura Ram Dhaka S/o Kumbharam Dhaka, Aged About 74 Years, R/o Village And Post Kangar, Tehsil Ratangarh, District Churu (Raj). ----Petitioner Versus
1. Head Post Master, Head Post Office Siliguri, District Darjeeling, West Bengal.
2. Sub Post Master, S.f.s. Mansarovar, District Jaipur, Rajasthan.
3. Superintendent Main Chief, Post Office, District Churu, Rajasthan. ----Respondents For Petitioner(s) : Mr. Rajesh Dhaka For Respondent(s) : -- HON'BLE MR. JUSTICE ANIL KUMAR UPMAN
Order 21/07/2025 The petitioner has preferred this writ petition with the following prayer:-
“It is, therefore, most respectfully prayed that your Lordship may graciously be pleased to accept and allow this writ petition and by an appropriate writ of mandamus, order or direction in nature thereof: i) the impugned order dated 25.03.2025 passed by Rajasthan State Consumer Dispute Redressal Commission may kindly be quashed and set aside with further direction to the respondents to make payment of total Rs. 5,78,751/- to the petitioner as claimed by him under various heads including
[2025:RJ-JP:27291] (2 of 3) [CW-7103/2025] interest on KVP Scheme and legal expenses, mental agony and other misc. expenses in his written argument dated 05.02.2025. ii) Any other order which the Hon’ble Court may deems fit and proper in the facts and circumstances of the case also be passed in favour of humble petitioner along with cost of writ petition.” Heard. Perused the material available on record. Before approaching the learned State Consumer Disputes Redressal Commission, the petitioner filed a revision petition (No.3583/2017) before learned National Consumer Disputes Redressal Commission New Delhi against the order dated 31.07.2015 passed in Appeal No.229/2014 by learned State Commission. The said revision was essentially pertaining to dispute with respect to payment of interest on Kisan Vikas Patra Schemes. However, vider order dated 30.09.2024, the said revision was dismissed as not pressed. However, liberty was sought by the petitioner that the grievance with respect to the calculation of interest based on the order of learned State Commission dated 31.07.2015 be permitted to be executed before the learned State Commission. Thus, the petitioner intended to pursue his case only with respect to calculation of interest based on the order dated 21.07.2015 and In pursuance of the aforesaid liberty, the petitioner approached learned State Commission and filed written statement where by order impugned dated 25.03.2025, after hearing submissions of both the sides, interest was calculated and paid to petitioner against receipt. As per the
order impugned, the petitioner did not oppose the calculation of
[2025:RJ-JP:27291] (3 of 3) [CW-7103/2025] interest. Be that as it may. In my considered opinion, if the petitioner is aggrieved of order of learned State Commission, same may be assailed before learned National Commission. But without availing suitable legal remedy, the petitioner has directly filed this writ petition. Accordingly, this writ petition is dismissed.
