By the present writ petition, the petitioner, who is working on the post of District Aayush Officer, is questioning the transfer order dated 03.04.2025 (Annexure P-1) by which the petitioner has been transferred from District Gariyabandh to District Balod on administrative exigency. 2. Learned counsel for the petitioner submits that the petitioner is questioning the transfer order stating that the circular dated 03/06/2015 categorically provides that if the Officer/ employee wish to remain in the scheduled area they should be allowed to remain posted there unless any complaint is received against them. According to the petitioner, she is an unmarried lady and her octogenarian father is fully dependent upon the petitioner. On the event of the transfer of the petitioner her father shall suffer irreparably as nobody is there to look after him. She would submit that the transferred place is situated at a distance of about 122 Kms. 3. Learned counsel for the respondents/ State on instructions, submits that, as far as, the transfer of employees of the State government is concerned, the State government has decided to constitute a committee to consider the grievance of the employees in case of transfer. He further submits that if the petitioner will approach the said committee, the committee will decide the same in accordance with law and the relevant transfer policy. 3 / 3 4. I have heard learned counsel for the parties and perused the documents. 5. Looking to the grievance of the petitioner, it is directed that the petitioner shall approach the committee constituted vide order dated 03.03.2025 by filing a representation within a period of 15 days from the date of receipt of a copy of this order. In case of filing of such representation, the said committee shall decide the representation of the petitioner in accordance with law and the relevant transfer policy, within a period of 30 days from the date of filing of such representation. 6. It is made clear that till the decision of the Committee, status quo, with regard to the posting of the petitioner, be maintained by the parties, as the learned counsel for the State would submit that the respondent No.3 has already joined at the present posting place of the petitioner on 09/04/2025. 7. The petitioner is at liberty to apprise the Committee with regard to the order passed by this court. 8. With the aforesaid direction, the Writ Petition stands disposed of.
