Heard learned counsel for the petitioner, Mr. Ran Vijay Singh, learned counsel for the respondent no.2, Mr. Shailendra Singh Rajawat, learned counsel for the respondent nos. 3 & 4 and Mr. Pradeep Kumar Singh, learned Additional Chief Standing Counsel for the State. By way of the present petition, the petitioner is challenging the orders dated 22.9.2025 and 25.09.2025 passed by District Basic Education Officer, Sultanpur and the Block Education Officer, Kadipur respectively. Contention of the learned counsel for the petitioner is that there is anomaly in the transfer order of the petitioner and once the petitioner is transferred, the school will remain as Ekal school. He submitted that the analogy, which is drawn while taking such decision, does not apply in the case of the present petitioner. He submitted that in hasty manner, the decision has been taken and, therefore, the orders impugned do not sustain in the eyes of law. On the other hand, learned counsel for the respondent no.2 submits that the matter can be reconsidered. In view of the consent given by both the parties, the impugned orders dated 22.9.2025 and 25.09.2025 are quashed. The petitioner is given liberty to move fresh representation before the respondent no.2/Secretary, U.P. Basic Shiksha Parishad, Prayagraj within a week and if such representation is moved, the respondent no.2 shall take a Versus Counsel for Petitioner(s) : Brijendra Singh, Anurag Kumar Verma, Prashant Pandey Counsel for Respondent(s) : C.S.C., Ran Vijay Singh, Shailendra Singh Rajawat Uday Pratap Singh .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Basic Education Lko. And 3 Others .....Respondent(s) decision in accordance with law within further period of thirty days from the date of production of certified copy of this order before him. Further it is open for the respondents to proceed in compliance of the fresh decision taken. With the aforesaid observations, present petition is hereby allowed at the admission stage.
