Heard the parties.
The petitioner has been made accused in connection with Birni P.S. Case No. 04 of 2025, corresponding to G.R. Case No.858 of 2025, for the offence registered under Section 310(2) of the BNS, pending in the court of learned C.J.M., Giridih.
On 03.01.2025, eight unknown persons committed dacoity in the house of the informant and looted Rs.2,50,000/-, jewelries and other articles from there.
It was submitted that petitioner is neither named in the F.I.R nor he was put on T.I. parade. It was further submitted that nothing incriminating has been recovered from the possession of the petitioner and this fact has been mentioned at paragraph-9 of the bail application.
Learned A.P.P on behalf of the State has opposed the prayer for bail.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned C.J.M., Giridih, in connection with Birni P.S. Case No. 04 of 2025, corresponding to G.R. Case No.858 of 2025.
