The petitioner, who was the Sarpanch of Gram Panchayat Salheona, Janpad Panchayat Raigarh, has challenged the order of suspension dated 5.4.2019 (Annexure-P/1). Learned counsel for the State would submit that the petitioner was placed under suspension vide order dated 5.4.2019, and the tenuure of the Sarpanch expired on 28.12.2019. Thus, the petition has become infructuous. 3. On the other hand, learned counsel for the petitioner would submit that the petitioner was placed under suspension contrary to the provisions of Section 39 of the Chhattisgarh Panchayat Raj Adhiniyam, therefore, the order is bad in law. 4. Heard counsel appearing for the parties and perused the documents present on record. 5. Taking into consideration the fact that the tenure of the office of Sarpanch has already expired, nothing survives for adjudication. 6. Consequently, this petition fails and is hereby dismissed.
