Heard the parties.
2. The petitioner has been made accused in connection with Putki P.S. Case No. 28 of 2023 corresponding to G.R. Case No. 2071 of 2024, for the offences registered under Sections 419, 420 & 34 of the Indian Penal Code, pending in the court of Smt. M. P. Lakra, learned J.M. 1st Class, Dhanbad.
3. Bail application of the petitioner was earlier rejected by this Court vide B.A. No. 9431/2024 by order dated 16.01.2025.
4. Co-accused Subal Kumar Upadhyay had taken loan of Rs. 56,73,946/- from the Bank of India, Dhanbad after pledging gold ornaments. The petitioner, who is the goldsmith, examined the ornaments and gave a certificate that gold ornaments pledged by the co- accused were genuine. Later on, co-accused Subal Kumar Upadhyay stopped paying EMI and subsequently, his loan account was declared NPA. The informant on being suspicious got the gold ornaments examined by other goldsmith and it was found that the gold ornaments were fake.
5. Report regarding the stage of trial and time required for its conclusion, earlier called for from the Court concerned, has been received. It appears that out of 10 charge-sheeted witnesses, only one witness has been examined yet.
6. It was submitted that petitioner has remained in custody for about a years. It was further submitted that offence alleged against the petitioner is triable by the Court of Judicial Magistrate.
7. In view of the submissions made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is
directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Smt. M. P. Lakra, learned J.M. 1st Class, Dhanbad or her successor in connection with Putki P.S. Case No. 28 of 2023 corresponding to G.R. Case No. 2071 of 2024.
