(Hon'ble Shri Naresh Kumar Chandravanshi, J) Order on Board 27-6-2025 1 This is 2nd bail application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita for grant of regular bail to the applicant, who has been arrested in connection with Crime No. 438/2023 registered at Police Digitally signed by AVANISH KUMAR PATHAK Date: 2025.06.30 11:18:23 +0530 2 Station Gandhinagar, Tehsil Ambikapur, District Sarguja (C.G.), for the offence punishable under Section 420 and 34 of the IPC. Her first bail application bearing MCRC No. 7430/2024 was dismissed as withdrawn by this Court vide order dated 22-3-2025. 2 Allegation against the applicant is that, she along with other co- accused persons, claiming them to be Directors of Sarguja Mart Pvt. Ltd., obtained huge amount from various villagers on account of drilling bore well, provided them loan for various purposes like poultry farm, teak farm, animal husbandry and when investors demanded their money back, then applicant and other co-accused persons did not return their money and thereby, they have cheated them/inverters. Based on above facts, written complaint was made, FIR was registered against applicant and other accused persons, applicant Lata Khunte was arrested on 1-3-2024 and after investigation, charge sheet has been filed on 14-4-2024 for the offence under Section 420/34 of IPC. 3 Learned counsel for the applicant submits that, charge sheet has been filed on 14-4-2024 for the offence under Section 420/34 of IPC, which is punishable upto 7 years jail sentence and the case is triable by JMFC, applicant is in jail since 1-3-2024, conclusion of trial may take long time, therefore, the applicant may be granted regular bail. 4 On the other hand, learned State counsel opposes the application for grant of bail and submits that there are 5 criminal antecedents against the applicant, which are pertaining to cheating and forgery, hence the instant bail application may be rejected. 5 Heard learned counsel for the parties and perused the case diary. 3 6 Having heard learned counsel for the parties and having regard to the facts and circumstances of the case, further considering the allegation against the applicant for the offence of cheating, which is punishable for a maximum period of 7 years, she is in jail since 1-3-2024 and conclusion of trial may take time, I feel inclined to release the applicant on bail. 7 Accordingly, the bail application is allowed and it is directed that the applicant shall be released on bail on her furnishing a personal bond in sum of Rs. 1,00,000/- with two sureties each of Rs. 50,000/- to the satisfaction of the concerned trial Court for her appearance before the trial court regularly on each and every date as per direction of the court, unless exempted from appearance.
