ANJARIA and HON'BLE MR JUSTICE M.I.ARUN ORAL JUDGMENT (PER: HON'BLE THE CHIEF JUSTICE MR. JUSTICE N. V. ANJARIA) Contempt is alleged in respect of the following directions found in the order in Writ Petition No.31536 of 2024 dated 16.12.2024 passed by the Co-ordinate Bench which are with respect to consideration of the case of the petitioner for his promotion, "In the above circumstances, this petition is allowed in part; the impugned order of the KAT, although in substance maintained, is modified to the effect that the jurisdictional respondents shall open the sealed cover forthwith and process the contents thereof. It hardly needs to be stated that a report of enquiry officer shall be furnished to the petitioner in terms of UNION OF INDIA v. MOHD. RAMZAN KHAN and the proceedings shall be culminated into some order, this side or that side, after consideration of petitioner's representation to the Enquiry Report thereof." 2. A reading of the aforesaid direction would show that no time limit is fixed for carrying out the direction. In the circumstances, it is - 4 - NC: 2025:KHC:9372-DB CCC No. 206 of 2025 not possible to conclude at this stage that any of the respondents have committed contempt, much less willful contempt. 3. Therefore, the contempt petition under the Contempt of Courts Act, 1971 is not entertaining. 4. However, in order to ensure that the orders and directions of the court do not go uncomplied with it is directed that the directions contained in the aforesaid order of learned single shall be acted upon by the respondents concerned within a period of eight weeks from today. 5.
