Learned counsel on behalf of the State submits that he has received instructions that there is no illegal encroachment made by the opposite party no. 6 over the rasta that has been pointed out by the counsel appearing on behalf of the petitioner. 2. Furthermore, we are of the view that the dispute being raised in the present writ petition is not maintainable as the petitioner has alternative remedies under Section 26 of the U.P. Revenue Code. 3. Learned counsel appearing on behalf of the petitioner submits that, that application is already pending. 4. In light of the same, we direct the officers concerned, being the Tehsildar to expeditiously look into the matter, grant opportunity of hearing to the petitioner and the private respondent and thereafter pass a reasoned order on the same within a period of four weeks from the date of receipt of certified copy of this order. 5.
