Heard Mr. S.C Biswas, learned senior counsel for the petitioners. Also heard Mr. P. Borthakur, learned Additional Public Prosecutor for the State. 2. This application under Section 483 of BNSS, 2023 has been filed by the petitioners, namely, 1. Asad Ahmed Laskar and 2. Junaid Ahmed Laskar, has prayed for bail in connection with Silchar P.S Case No. 584/2025 registered under Sections 111(3) /111(4) /111(5) /111(6) / 111(7)/112(2)/305(e)/318(3)/318(4) of BNS,2023, R/W Section 7 of Essential Commodities Act,1955. 3. The FIR reveals that on 02.06.2025 at about 2:30 PM riding party of Silchar P.S Town Branch detained one suspected oil tanker bearing registration no.AS-09AC-6369 along with loaded oil at Annapurnaghat Point near Sharma and Company Petrol Pump which was proceeding towards Hailakandi from IOC Moynarbond, Silchar but the driver of the said oil tanker namely Churamoni Singha failed to produce any legal document/challan of the loaded oil. 4. During interrogation, the driver of the said oil tanker disclosed the names of Monojir Rahman Laskar and Rajib Laskar of Sildubi who stocked oil near IOC, Moynarbond and they directed the said driver to transfer the oil to Hailakandi and on permission of Page No.# 3/4 owner of the oil tanker namely Mohon Deb of Sonai road, the driver moved from Moynarbond, Silchar towards Hailakandi but they did not issue any document/challan for carrying the oil. At per instruction of the O/C, Silchar PS, the said driver was allowed to collect all legal documents from his oil owner but on 04.06.2025, they failed to produce any legal document/challan of loaded oil and hence, the said oil tanker was seized in presence of witnesses. 5. On perusal of the case diary, it appears that there is some material involving the present petitioners. However, considering the progress of the investigation and period of detention of 84 days, further detention is not considered necessary. Accordingly, prayer for bail is allowed. 6. Accordingly, the above-named petitioners are allowed to go on bail of Rs.50,000/- (Rupees Fifty Thousand) only each with two sureties each of like amount subject to the satisfaction of the learned Additional CJM, Silchar, Cachar with following conditions: (i) That the petitioners shall not commit any offence while on bail. (ii) That the petitioners shall not hamper or tamper any evidence. (iii) That the petitioners shall not directly or indirectly make any inducement, threat or promise to any person who may be acquainted with the facts of the case so as to dissuade such person from disclosing such facts of the case before the Investigating Officer; Page No.# 4/4 7.
