MANDAPALLI VILLAGE, RAJAMPET MANDAL, YSR DISTRICT ...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order, direction more particularly one in the nature of WRIT OF MANDAMUS declaring the action of the 2nd respondent in issuing proceedings No.751/CPRandRD/S/2019, dated 10-02- 2020, wherein the changing the location of the village secretariat from Mandapalli village, Rajampet Mandal, YSR district to Seshamarnbapurarn village, Rajampet Mandal, YSR district at SI.No.22 as illegal, arbitrary, colourable exercise of power and contrary to G.O.Ms.No.110, PR 86 RD, Department, dated 19-07- 2019 and also violation of Article 14, 19 and 21 of the Constitution of India and set-aside the same and consequently direct the respondents to continue the village secretariat at Mandapalli village, Rajampet Mandal, YSR District and to pass Counsel for the Petitioner: 1. GP FOR PANCHAYAT RAJ RURAL DEV 3 HON’BLE SRI JUSTICE VENKATESWARLU NIMMAGADDA W.P.No.15967 of 2020 This Court made the following ORDER: Heard learned counsel for the petitioner and learned Standing Counsel for Respondent No.4 and perused the material placed on record. 2. Learned counsel for the petitioner submits that initially the 2nd respondent herein issued proceedings giving administrative sanction for construction of Village Secretariat at Mandapalli Village, Rajampet Mandal, YSR Kadapa District. While so, later the Respondents for one reason or the other proposed to change the location of Village Secretariat from Mandapalli to Seshamambapuram Village, Rajampet Mandal, which is one of the cluster villages of Mandapalli. He further submits that in view of the Rules framed under G.O.Ms.No.110, once the proceedings issued for construction of Village Secretariat at Mandapalli, it cannot be shifted to other village i.e., Seshamambapuram in contrary to the terms of G.O.Ms.No.110, Panchayat Raj & Rural 4 Development (MDL-I) Department, dated 19.07.2019. Hence the writ petition. 3. At the stage of admission of this Writ Petition, this Hon’ble Court passed an interim orders dated 05.10.2020 directing the respondents to maintain status-quo pursuant to the proceedings of District Collector dated 10.02.2020 and the said interim order has been extended from time to time. 4. Learned Standing Counsel for Respondents furnished written instructions dated 18.09.2025 submitted by the 6th respondent, wherein it is stated that since the 2nd respondent granted administrative sanction on 24.04.2020 for construction of Village Secretariat at Mandapalli Village and also in view of interim direction, the basement construction of Grama Sachivalayam building, Rythu Bharosha Kendram at Sy.No.314, in an extent of Ac.0.20 cents of Diguva Mandapalli Habitation of Mandapalli Grama Panchayat was completed in July, 2022 and further stated that as of now the Village Secretariat of is functioning from the old Gram Panchayat Office at Mandapalli only. 5. Considering the submission made by both the counsel and written instructions submitted by the 6th respondent, it is clear and 5 categorical that the Village Secretariat of Mandapalli is established in terms of G.O.Ms.No.110, and has been functioning at old Gram Panchayat Office at Mandapalli only. It is also an admitted fact that construction of Village Secretariat has already been started at Sy.No.314 of Mandapalli Village only. Therefore, as contended by learned counsel for the petitioner the respondents are proposing to change the location of construction of Village Secretariat at Seshamambapuram is only an apprehension of the petitioner. In the absence of any proceedings for construction of Village Secretariat at Seshamambapuram is only mere an apprehension of the petitioner without there being valid any reasons. 6. In view of the observations made as above, no further orders are required and do not warrants further adjudication in the matter and accordingly the Writ Petition is closed.
