This writ petition has been filed with the following prayer: "To direct the Additional District Judge/ F.T.C. 1st, Basti to decide the Stay Application-5-Ka dated 30.09.2015 pending in the Misc. Appeal No. 78 of 2015 (Dr. Mohammad Husain and another Vs. Shaukat Ali and others) within stipulated period fixed by this Hon'ble Court." It is contended that the defendant had moved a stay appliation 5- Ka dated 30.09.2015 in Misc. Appeal, which is pending consideration since then. The sole prayer prayer made in the writ petition is for expeditious disposal of the said stay application. As no useful purpose would be served in keeping the matter pending, the writ petition is being disposed of, at the admission stage, without calling for counter affidavit or issuing notice to private respondents, with a direction upon Additional District Judge/F.T.C. 1st, Basti to decide stay application 5-Ka dated 30.09.2015 in Misc. Appeal No.78 of 2015 (Dr. Mohammad Husain and another vs. Shaukat Ali and others), in accordance with law, after hearing all affected parties, preferably within a period of two months from the date of production of certified copy of this order. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
