Heard Mr. S. Mitra, learned counsel for the petitioner. Also heard Mr. P. Borthakur, learned Addl. P.P., Assam appearing for the respondent State. This Interlocutory Application has been filed for alteration/modification of the bail condition enumerated in para 6(a) of the order dated 22.06.2023, passed in Bail Application No.2072/2023, wherein it was directed that the petitioner shall not leave the territorial jurisdiction of the learned CJM, Kamrup (Metro) at Guwahati, without his prior written permission. In pursuant to the said bail condition, the present petitioner had appeared before the learned CJM, Kamrup (Metro) at Guwahati for ten (10) time till date, seeking permission to leave the jurisdiction of the learned CJM, Kamrup (Metro) at Guwahati, as he is a resident of Bilashpur in the State of Chhattisgarh, wherein he has business establishment. Mr. S. Mitra, learned counsel for the applicant further submitted that the FIR of the case was lodged on 11.06.2022. But even after lapse of more than three years, the charge sheet has not been filed in the present case. However, the applicant is ready and willing to extend his cooperation in further investigation Page No.# 3/3 of the case, if his presence is required. But till date, the I.O. has not call for the present applicant to appear before the police station. However he is ready to appear, as and when it is required. Mr. P. Borthakur, learned Addl. P.P., Assam for the respondent State submitted that the said bail condition may be altered/modified, with a direction to the applicant to provide his telephone number and other documents for his identification before the concerned I.O. and also may be directed to appear before the I.O., as and when required for the purpose of investigation of the case. Considering the submissions made by learned counsel for both sides, the present Interlocutory Application is allowed and accordingly the bail condition No.6(a), passed in Bail Application No.2072/2023, on 22.06.2023 is modified as under: “6(a) The petitioner shall give the telephone details and the copy of Identity Card, Aadhaar Card and Pan Card, etc. before the CJM, Kamrup (Metro) at Guwahati and shall appear before the I.O. of the case, as and when his presence is required”. With the above alteration/modification, this Interlocutory Application stands disposed of. JUDGE Comparing Assistant
